These five guardianship proceedings were brought following the refusal of the Division of Parole and the Department of Correctional Services to release on parole five prisoners who had lost the capacity to participate in the release process as a result of serious illness. Guardianship was used as a way of appointing a party legally authorized to sign the necessary documents thereby allowing the inmate to leave prison to die at home with his/her family. As prisoners become elderly or mentally incompetent during their incarceration as a result of illness, guardianship actions become more important.
